“Supreme Court Orders NMC to Provide Stipend Details for MBBS Interns Across All States”

“In a significant development concerning the payment of stipends to doctors during their MBBS internships, the Supreme Court on April 1 issued a decisive directive to the National Medical Commission (NMC), urging them to furnish detailed information on the stipend status across medical colleges in all states.

The Court highlighted the NMC’s failure to provide comprehensive data on all medical colleges nationwide, noting the non-compliance of an earlier directive issued on September 15, 2023. This directive had requested the NMC to present a tabulated chart addressing whether 70% of medical colleges fail to pay any stipend to interns or pay an amount below the minimum stipulated amount. Additionally, it sought clarification on the measures being taken by the NMC to enforce stipend payment norms.

Expressing dissatisfaction with the incomplete details provided by the NMC, a bench comprising Justices Sudhanshu Dhulia and Prasanna B Varale instructed the commission to rectify this within four weeks.

During previous hearings, the bench expressed concerns over medical colleges inadequately compensating interns despite charging substantial fees. Justice Dhulia criticized the colleges for their stance, emphasizing that if they charge exorbitant fees, they should also fulfill their obligation to pay stipends.

Advocate Tanvi Dubey, representing the petitioners, highlighted that even Foreign Medical Graduates (FMGs) were not receiving stipends. The Court, expressing discontent, observed that FMGs should not be treated differently.

Supreme Court Takes Firm Stance on MBBS Interns’ Stipend Issue: A Closer Look

In a significant move, the Supreme Court of India, led by Justices Sudhanshu Dhulia and Prasanna B Varale, recently addressed a longstanding grievance of MBBS interns concerning the lack of adequate stipends from medical colleges. Justice Dhulia, vocal about the discrepancy, argued that colleges have a binary choice: either ensure the payment of stipends to interns or abstain from offering internships altogether.

This issue is not isolated but reflects a broader concern previously highlighted by the Supreme Court. The court had already issued directives to the National Medical Commission (NMC) to investigate and resolve reports indicating that a staggering 70 percent of medical colleges failed to disburse stipends to their MBBS interns. The Army College of Medical Sciences (ACMS) emerged as a specific case in point, with the court having to intervene directly to mandate the payment of stipends to its interns, who had been unpaid since their joining in April, only receiving stipends from October onwards.

Senior Advocate Colonel (Retired) R Balasubramanium, representing ACMS, contended that the college operates independently, without direct government or military funding, hinting at financial constraints as a possible reason for the delayed stipends. However, the court’s directive was clear: ACMS must expedite the payment process, reinforcing the principle that interns deserve to be compensated for their contributions.

Moreover, the Supreme Court expressed its concern over the NMC’s adherence to its directives aimed at ensuring stipend payments across the board. The court pointed out inconsistencies between reported state responses and the actual situation on the ground, indicating a gap in compliance and implementation.

The case has been adjourned for further submissions and has been tagged alongside similar petitions, including those filed by foreign medical graduates facing non-payment of stipends. This collective judicial scrutiny underscores a pivotal moment in addressing the financial challenges faced by MBBS interns in India, potentially setting a precedent for how medical education institutions treat their interns moving forward.

This judicial intervention by the Supreme Court marks a crucial step towards rectifying the imbalance between the financial burdens imposed on medical students and the lack of compensatory stipends for their indispensable service during their internship period. The medical aspirants seeking MBBS/BDS admission at Haryana will have to register themselves through the Combined centralized counseling Deptt. of Medical Education & Research (DMER) Haryana by filling out their application form. Haryana, MBBS/BDS admission is done on the basis of marks secured in NEET. Candidates who will qualify NEET Exam and meet the eligibility requirements can only register and fill the application form for Haryana MBBS / BDS  admission. DMER Haryana counseling is conducted in Three rounds (Round 1(online), Round 2(Physical Counseling), and Mop-up Round(Physical Counseling)). The fourth round is the College Round, if the number of vacant seats is x, then a 10x list of registered candidates will be sent to the college and is to be exhausted strictly in order of merit.

Eligibility Criteria
  • The admission to MBBS/BDS Courses shall be open to candidates who have qualified NEET-UG 2021 and eligible as per Punjab Govt. notifications and subsequent amendment(s)/corrigendum(s) and as well as Punjab Govt. Personnel Department letter dated 06.06.1996.
  • Merely applying for admission to MBBS/BDS courses on the basis of NEET-UG-2021 will not entitle the Candidates eligibility. A Merit of a candidate for admission will be determined by the Admission Committee strictly as per rules and regulations laid down in the Punjab Govt. Notification(s) as published in this prospectus and all other such documents as are required with the ADMISSION APPLICATION FORM.
  • Counselling/Admissions shall be conducted by the Admission Committee constituted by the Punjab Government for this purpose.

The selection committee DME (Directorate of Medical Education) will conduct Counselling for Tamil Nadu MBBS/BDS NEET 2021. The admission for MBBS/BDS shall be made on the basis of NEET UG 2021.  Rounds of Counselling 

First round of Counselling

  • The candidates should pay a non-refundable amount of Rs.500/- (or) by means of Demand Draft payable at Chennai on the
    scheduled date of counselling.
  • The candidates can download the call letter from the official Website, take a printout of the call letter and report in person with all the required certificates to the venue as per the schedule.
  • The candidates who have been selected in the first round of counselling after certificate verification should receive the provisional allotment Letter, and join the college before the date mentioned in the allotment letter.
  • The candidates who have been allotted seats and failed to join the college within the given time are not eligible to attend the subsequent rounds of counselling for the year 2021-22. (This shall be applicable for all phases of counselling).
  • The candidates who have failed to report in person for the first round of counselling are assumed to have been opted out from the counselling process and that individual will not be allowed to take part in the subsequent rounds of counselling for the year 2021-22

Second round of Counselling

  • When a candidate is scheduled to attend the second round of counselling, then the candidate has to pay the processing fee of Rs.500/-. (The candidates who are waitlisted/allotted need not pay the processing fee.)
  • Re-allotment/allotment for the vacancies arising due to not joining of the candidates allotted under State Quota and the unfilled seats from the All India Quota in Government Medical Colleges and newly created seats, if any will be done on the basis of the rank following the rule of reservation.
  • During the second round of counselling, candidates will be permitted to opt the course/college as per rank and by following the rule of reservation from rank one.
  • The candidates who have failed to appear in person for the second round of counselling are assumed to have been opted out from the processes of counselling and that individual will not be allowed to take part in the subsequent rounds of counselling for the year 2021-22. The candidates can download the call letter and attend the counselling.
  • The candidates who have been selected in the second round of counselling after certificate verification should receive the provisional allotment letter. The candidates should join the college on or before the date mentioned in the provisional allotmentvletter.
  • If a candidate fails to join the College within the given time, he/she will not be permitted to participate in the further rounds of counselling.

Mop-Up round of Counselling

  • Finally, the Mop-up counselling will be done. The candidates will be permitted to opt for the college as per rank by following rule of reservation from rank one subject to the availability of sufficient time before the cut-off date as prescribed by the National Medical Commission (erstwhile Medical Council of India / Dental Council of India.
  • The candidates who have joined/waitlisted from the first and second rounds of counselling and as per the mop-up counselling schedule are eligible to participate in the mop-up counselling.
  • The candidates who have selected seats in the mop-up counselling and have received their provisional allotment letter should report in person before the respective Medical / Dental College on or before the given date and time mentioned in their provisional allotment letter.
  • If he/she fails to join in the specified time and date in the respective college, it will be considered as discontinued and the candidate should pay the penalty as per Clause18 (a).
  • If it is found that a candidate has been involved in impersonation/suppression or misrepresentation of facts and production of falsified / bogus certificates by the candidates, his/her provisional allotment order will be cancelled and legal proceedings/criminal action will be initiated.

A candidate should obtain a minimum of marks at 50th percentile in National Eligibility Cum Entrance Test to MBBS/BDS to become eligible for admission to MBBS / BDS Courses for the academic year. However, for candidates belonging to Scheduled Castes, Scheduled Tribes, Other Backward Classes, the minimum marks shall be at 40th percentile. In respect of candidates with BenchMark Disabilities specified under the Rights of Persons with Disabilities Act, 2016, the minimum marks shall be at 45th percentile for the unreserved category candidates and 40th percentile for SC/SCA/ST / OBC candidates.
  • The minimum age of the candidate applying must be 17 years as on December 31, 2021.
  • The candidates belonging to other states who have qualified their class 6 to class 12 from the Tamil Nadu state will be eligible for admission under the open category.
  • Aspirants must have completed their class 12 with Physics, Chemistry, Biology, Biotechnology and, English as the compulsory subjects with a minimum aggregate of 50% marks (45% for PwD candidates and 40% for SC/ST/OBC candidates).
  • The candidate should be a citizen of India
  • Overseas Citizens of India(OCI) are allowed but there is no reservation for them. They can apply ion open Category.
  • Candidates who have studied Class 6 to 12 from schools situated in Tamil Nadu or partly or completely from other states will be required to submit their parent’s birth certificate, ration card, and class 10 or 12 certificates as proof of domicile
  • Candidates who do not belong to the Tamil Nadu domicile but have completed Class 6 to 12 from the state can apply for Tamil Nadu NEET 2021 admission under the open category.
Reservations

The selection process will be made based on NEET – UG 2020 score and by Single Window counselling following the rule of reservation by the Government of Tamil Nadu as follows:-

NTA (National Testing Agency) announced the NEET UG Results on 2nd November 2021. The NEET UG Exams which was conducted on September 12, 2021, across the country. Over 16 lakh people appeared for the NEET UG exams. The qualified students can register for counselling of MCC and other states counsellings.

As per the report in TOI, across the country, Nine states recorded 60% and above qualification with Delhi registering the highest at 76.61%, followed by Chandigarh at 75.04%. States with over one lakh candidates and over 50%? qualification include Karnataka 57.64%, Kerala 58.85%, Rajasthan 66.17%, Tamil Nadu 54.4% and Uttar Pradesh 53.81%. There are 13 Boards with over 50% qualification. The boards which showed significant improvement in Neet UG this year are Goa, Gujarat and Maharashtra as well as the North-east region except Manipur.

The Rajasthan Board leads in the respective share of top one lakh qualified candidates with 19.77%, followed by Odisha 14.88% and CBSE 14.54%. States wise Rajasthan and up have the highest number of candidates in the rank cohort of 1 – 1 lakh which include Rajasthan, Tamil Nadu, Uttar Pradesh and Bengal.

NEET UG 2021 update: Extension of Phase 2 and Modify the online application form window

National Testing Agency (NTA) extends the date for filling up of the Phase 2 application and for correcting the online application form for NEET UG 2021.

The candidates can now fill the registration process and modify the particulars in their NEET UG 2021 online application form up to 26th October 2021, Tuesday 11:50 p.m at the official website.

The NTA stated that “On receiving numerous requests from the candidates, the National Testing Agency is again opening the window for filling up of the second set of Information and correct/modify the particulars of the first and second phase of online application form for NEET (UG) 2021.”

They can modify/correct the field like:

  • Gender
  • Nationality
  • e-mail address
  • Category
  • Sub-category
  • Fields of second phase

The candidates who are interested may avail this facility as the final and end opportunity for correcting their particular in the first and second phase of the Online Application Form of NEET (UG) – 2021.

This facility is also open for candidates who had done one-time correction, earlier in this particular fields.

The agency mentioned, “The Candidates are strongly advised to check, cross-check, and verify their registered e-mail address and ensure that it is their own e-mail address only as NTA will be sending the scanned copy of the Scorecard to the registered e-mail address.”

“In case any candidate faces difficulty in making corrections of the Online Application Form of NEET (UG) – 2021, he/she can contact on 011-40759000 or e-mail at neet@nta.ac.in.,” it added.
