Karnataka High Court Orders 17 Private Medical Colleges to Surrender NRI Quota MBBS Seats

Bengaluru, August 13, 2024 — In a landmark decision, the Karnataka High Court has directed 17 private medical colleges in the state to surrender a significant portion of their MBBS seats from the NRI quota to the state government quota. This ruling comes as a result of a 2018 seat-blocking scandal, where these institutions were allegedly involved in illegal seat blocking activities.

The directive, issued by the Karnataka High Court on April 25, 2024, mandates that the colleges surrender a total of 212 MBBS seats to the state government for the current academic year. The decision follows disciplinary actions taken against these colleges, which included barring students from examinations by the Rajiv Gandhi University for securing seats through illegal means.

Transparency and Fairness Emphasized

The Directorate of Medical Education (DME) has been tasked with enforcing the court’s order. The DME has instructed the National Medical Commission (NMC) to ensure that these seats are excluded from the Medical Counselling Committee (MCC) counseling process and are instead added to the state government’s seat matrix.

Additionally, the DME has required the involved colleges to submit an undertaking that they will maintain transparency and fairness in their future admissions processes. This undertaking must include a commitment to base all admissions strictly on merit and to refrain from any seat-blocking or manipulative practices.

Consequences for Non-Compliance

The order also warns that failure to comply with these directives will result in punitive actions, including the potential for further reductions in the number of seats allocated to these colleges in the future.

This ruling is seen as a significant step towards ensuring a more equitable and transparent medical admission process in Karnataka. By shifting these NRI quota seats to the state government quota, the High Court aims to provide more opportunities for meritorious students who may have been disadvantaged by the earlier malpractices.

As the academic year progresses, the DME is expected to closely monitor the compliance of the colleges with these new directives, ensuring that the admissions process aligns with the highest standards of fairness and integrity.

For students and parents, this decision is a reminder of the importance of vigilance and adherence to legal processes in the highly competitive field of medical education. The Karnataka High Court’s ruling serves as a warning to institutions that malpractice will not be tolerated, and transparency is paramount in the allocation of educational opportunities.

This significant step is conducted via an online mode, opening doors for countless aspirants dreaming of embarking on a career in medicine. The counselling process is crucial for securing a place in both government and private medical and dental colleges across the state, offering courses in MBBS and BDS.

A Closer Look at UP NEET Counselling 2023

The UP NEET Counselling is designed to fill 85% of quota seats in government colleges and a full 100% in private medical colleges within the state. This initiative aims to streamline the admission process, ensuring that candidates can secure their spots in the various government and private medical/dental schools and universities.

Key Considerations for Candidates:
  • No Free Exit: Candidates should note that there’s no option for a free exit after seat allotment in any counselling round. However, a free exit is possible if an allotment letter from another state is submitted.
  • Security Deposit: The security deposit paid during the counselling process is non-refundable if admission is not taken after the seat allotment. Furthermore, if a candidate fails to report to the college in the first round, the security deposit will be forfeited. To participate in Round 2, a new security deposit is required.

Supreme Court Takes Firm Stance on MBBS Interns’ Stipend Issue: A Closer Look

In a significant move, the Supreme Court of India, led by Justices Sudhanshu Dhulia and Prasanna B Varale, recently addressed a longstanding grievance of MBBS interns concerning the lack of adequate stipends from medical colleges. This action came to light through writ petitions filed by medical students, underlining the judiciary’s active role in advocating for fair compensation in the medical education sector.

The heart of the matter lies in the complaints lodged by MBBS interns over the insufficiency of stipend payments by medical colleges. The interns, despite being an integral part of the healthcare delivery system during their internship period, found themselves financially unrewarded, a situation exacerbated by the colleges’ insistence on hefty tuition fees. Justice Dhulia, vocal about the discrepancy, argued that colleges have a binary choice: either ensure the payment of stipends to interns or abstain from offering internships altogether.

This issue is not isolated but reflects a broader concern previously highlighted by the Supreme Court. The court had already issued directives to the National Medical Commission (NMC) to investigate and resolve reports indicating that a staggering 70 percent of medical colleges failed to disburse stipends to their MBBS interns. The Army College of Medical Sciences (ACMS) emerged as a specific case in point, with the court having to intervene directly to mandate the payment of stipends to its interns, who had been unpaid since their joining in April, only receiving stipends from October onwards.

Senior Advocate Colonel (Retired) R Balasubramanium, representing ACMS, contended that the college operates independently, without direct government or military funding, hinting at financial constraints as a possible reason for the delayed stipends. However, the court’s directive was clear: ACMS must expedite the payment process, reinforcing the principle that interns deserve to be compensated for their contributions.

Moreover, the Supreme Court expressed its concern over the NMC’s adherence to its directives aimed at ensuring stipend payments across the board. The court pointed out inconsistencies between reported state responses and the actual situation on the ground, indicating a gap in compliance and implementation.

The case has been adjourned for further submissions and has been tagged alongside similar petitions, including those filed by foreign medical graduates facing non-payment of stipends. This collective judicial scrutiny underscores a pivotal moment in addressing the financial challenges faced by MBBS interns in India, potentially setting a precedent for how medical education institutions treat their interns moving forward.

This judicial intervention by the Supreme Court marks a crucial step towards rectifying the imbalance between the financial burdens imposed on medical students and the lack of compensatory stipends for their indispensable service during their internship period. As the case progresses, it will be interesting to see how this decision influences the policies of medical colleges across the country and the actions of the NMC in enforcing these directives.
